These Terms of Service (“Terms”) are a binding agreement between you and Eagle Clubhouse (“Eagle Clubhouse,” “we,” “us,” or “our”). Eagle Clubhouse is operated by an individual sole proprietor based in California. These Terms govern your access to and use of the Eagle Clubhouse mobile and web applications and related services (collectively, the “Service”).
By creating an account, or by accessing or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.
You must be at least 13 years old to use the Service. If you are under the age of majority where you live (typically 18), you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
By using the Service you represent that you meet these requirements and that the information you provide is accurate. The Service is currently offered to users in the United States; we make no representation that it is appropriate or available for use elsewhere.
You may need to create an account to use most features. During our pre-release period, creating an account may require a valid invite code or placement on a waitlist, and we may grant, limit, or revoke access at our discretion.
You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Provide accurate information, keep it current, and notify us promptly of any unauthorized use. Do not impersonate others, create accounts for anyone else without authorization, or share, sell, or transfer your account.
The Service lets you create and share content such as reviews, ratings, photos, round logs, profile details, messages, and marketplace listings (“User Content”). You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, adapt, and distribute your User Content for the purposes of operating, improving, and promoting the Service. You represent that you have the rights necessary to share your User Content and that it does not violate any law or any third party’s rights.

There is no tolerance for objectionable content or for members who abuse other members. Content that breaks the rules above will be removed, and the accounts responsible will be suspended or terminated. We aim to review reports within 24 hours.
You can report User Content from the menu beside it, and you can block another member from their passport, from a conversation, from a comment, or from your friends list. Blocking hides the two of you from each other and stops them contacting you. Reviews and ratings reflect the opinions of the members who post them, not us.
The Pro Shop lets users list and discover golf gear and related items. Eagle Clubhouse is a venue only — we are not a party to, and do not participate in, any transaction between buyers and sellers. We do not process payments, hold funds, ship items, verify listings, or guarantee that any item is as described, authentic, or legal to sell, or that any transaction will be completed.
Buyers and sellers arrange payment and delivery directly and entirely off-platform, at their own risk. You are solely responsible for your listings, for complying with all applicable laws (including tax and any laws governing items you may not legally sell), and for independently evaluating and completing any transaction. We are not responsible for any loss, dispute, or harm arising from marketplace activity, and we may remove listings and suspend accounts at our discretion.
The Service — including its software, design, logos, the Eagle Clubhouse name and crest, and the content we provide (excluding User Content and third-party data) — is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use in accordance with these Terms. You may not copy, modify, distribute, sell, or create derivative works from the Service without our prior written permission.
The Service relies on third-party providers and incorporates third-party data, including hosting and infrastructure (such as Supabase and Vercel), maps and place information (such as Google and map-tile providers), and weather data. Course, club, and location information may come from third-party and public sources and may be incomplete or inaccurate. We do not control, and are not responsible for, third-party services, and your use of them may be subject to their own terms.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any information — including course details, ratings, distances, GPS, or weather — is accurate or current. You use location and GPS features at your own risk and should not rely on them for safety-critical purposes.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EAGLE CLUBHOUSE AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless Eagle Clubhouse and its operator from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your User Content, your use of the Service, your marketplace activity, or your violation of these Terms or of any law or third-party right.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, if you violate these Terms, create risk or legal exposure for us, or for any other reason at our discretion.
Provisions that by their nature should survive termination — including the content licenses you have granted, disclaimers, limitations of liability, and indemnification — will survive.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after the changes take effect means you accept the revised Terms.
